Is there a Nebraska prevailing wage law being implemented for public projects?
Yes. It was adopted in 1923. It’s most current amendment was done in 1999.

What does “Fair Labor Standards” mean?
It is the rate of wages and labor conditions that is being maintained by a minimum of 50% of prevailing wage contractors that are engaged in the same line of business.

How are the rates for prevailing wage contractors determined?
Neb. Rev. Stat 73-104 does not directly refer to any “prevailing wage”. However, it stipulates that contractors who are working on public projects must pay wages that are paid by at least 50 percent of the prevailing wage contractors to workers who are employed in a similar field of endeavor or business. The law also doesn’t allow actions that will make the cost of public work contracts go higher. Predetermination of prevailing wage rates by the state isn’t also provided.
